Education Law

Our Education Law Group represents public and private universities and colleges, community and professional schools, public school districts, charter schools and private educational services organizations in New Jersey and throughout the Mid-Atlantic Region.

We assist our clients with board governance, litigation, counseling, audit, investigations and/or training services related to Individuals with Disabilities Education Act (IDEA), Americans with Disabilities Act (ADA), Age Discrimination in Employment Act (ADEA), Special Education, Title VII, Title IX and related statutory, regulatory or constitutional claims. We handle a wide array of matters for our education law clients such as:

  • Collective bargaining, tenure and general labor and employment matters
  • Education law, Title 18 and related statutes and regulations
  • General corporate matters
  • Human resources, personnel, employment training and employee-risk management
  • Independent investigation of complaints
  • Institutional compliance with state and federal laws, such as the Clery Act, Family Educational Rights and Privacy Act (FERPA) and Title IX
  • Litigation related to any of these matters as well as on general institutional issues
  • Open Public Records Act (“OPRA”) and Open Public Meetings Act (“OPMA”) compliance matters
  • Public procurement matters
  • Regulatory matters before state and federal agencies
  • Special education, IDEA, ADA and related matters
  • Title VII, First Amendment, age and disability claims
  • Title IX audit, compliance and training

In addition, our Labor Law Group handles all labor law issues pertaining to New York and New Jersey charter schools and public schools as well as public and private colleges and universities, including union-free workplace training, guidance through election campaigns and representation in collective negotiations, mediation, fact-finding and grievance arbitration. Also, we represent schools in all matters before the New York Public Employment Relations Board and the New Jersey Public Employment Relations Commission or National Labor Relations Board (NLRB).

Our Labor Group negotiated the only known compensation matter under the New Jersey Education Association (NJEA), which contains a merit-based salary component, for one of our charter school clients. In addition, we assist schools with tenure changes, employee discipline and any other personnel issues.
