Daniel Stolz and Donald Clarke to Participate at the 2025 AFBNJ Bankruptcy Bench Bar Conference

Firm Partners and Bankruptcy Law specialists Daniel M. Stolz, Esq. and Donald W. Clarke, Esq. will participate at the 2025 Honorable William Gindin Bankruptcy Bar Conference hosted by the Association of the Federal Bar of New Jersey on May 2nd. 

Mr. Stolz, Chair of the firm's Bankruptcy, Reorganization & Creditors' Rights Practice, will moderate the "Bankruptcy Case Law Update" panel discussion which will serve as a review of recent bankruptcy opinions with emphasis on the District of New Jersey and Third Circuit

Mr. Clarke will participate on a panel entitled, "What it Takes to be Heard in Bankruptcy Court: Standing Before and after Truck". This panel, which includes attorneys who have argued on opposite sides of this issues, will involve a robust discussion of the three elements of standing; the implications of Truck Insurance Exchange v. Kaiser Gypsum Co., including the breadth of its applicability in bankruptcy proceedings and what it currently takes to be heard in a Chapter 11 bankruptcy proceeding; and the requirements for obtaining derivative standing to assert claims that belong to a debtor's estate.
