Second Circuit Clarifies OWBPA Requirements for ADEA Release in a Separation Agreement

View article In an important and potentially far-reaching employment decision decided earlier this month, the United States Court of Appeals for the Second Circuit (“Second Circuit”) fleshed out the Older Worker Benefits Protection Act (“OWBPA”), 29 U.S.C. § 626(f), requirements for a release of claims made under the Age Discrimination in Employment Act (“ADEA”), 29 U.S.C. § 621 et seq., in a separation agreement.
