Charles J. Messina, Firm Partner and Co-Chair of the Cannabis Law Practice Group, discusses the need for cannabis/CBD companies and businesses at large to protect themselves from Telephone Consumer Protection Act (TCPA) lawsuits in his recent Guest Column published by NJ Cannabis Insider.

Mr. Messina explains that marketing by telephone calls and text messages — especially in the cannabis and hemp industries “which already face significant restrictions marketing online and in general” — have ramped up in 2020 as a result of the global pandemic. He then talks about the law and how it is evolving along with the “onslaught of claims being filed this year alleging that these companies are harassing consumers with spam text messages in violation of the Telephone Consumer Protection Act.”
