    William F. Harrison and Ralph J. Salerno Named to New Jersey Real Estate Advisory Board

    Partner William F. Harrison and Counsel Ralph J. Salerno have been named to the New Jersey Real Estate Advisory Board.  The Advisory Board was recently created by Governor Corzine to support the initiatives outlined in the Governor's Economic Assistance and Recovery Plan.  The panel consists of economic development leaders throughout the State, representing a range of New Jersey’s major businesses and will work closely with the Governor’s Office of Economic Growth as well as other State Departments to encourage economic development and revitalization across the state.

     

    Mr. Harrison and Mr. Salerno are members of the GBV Commercial Real Estate, Redevelopment & Environmental Law Practice Group and are based in the firm’s Newark, New Jersey office.

    GBV Partner Francis J. Vernoia Obtains Temporary Restraints Enjoining the County of Monmouth from Awarding Contract in Government Procurement Matter

    On December 23, 2008, GBV Partner, Francis J. Vernoia, successfully obtained a temporary injunction barring the County of Monmouth from proceeding with an award of a multi-year multi-million dollar contract to a transportation services company.  GBV’s client was the second lowest bidder on a contract which was awarded by the County of Monmouth to the lowest bidder in this government procurement matter under the New Jersey Public Contract Law.  The court agreed with the emergent legal challenge to the award of the contract to the lowest bidder and temporarily enjoined the County of Monmouth from awarding the contract to the lowest bidder. 

    Mr. Vernoia is the Director of the firm’s Complex Commercial Litigation Practice Group and is based in the Newark, NJ office.

    A Powerful Complaint Causing a Municipality to Immediately Repeal Zoning Amendment was filed by Partner William F. Harrison and Associate Lisa A. John

    The municipality adopted an amendment to its zoning ordinance, which substantially restricted our client’s ability to develop its property.  Mr. Harrison and Ms. John filed a Complaint, on behalf of our client, the owner of approximately 1,800 acres of land affected by the zoning amendment on both procedural and substantive grounds. The Complaint sought to invalidate the amendment based on procedural deficiencies in its adoption, arbitrary and capricious actions by the local planning board and governing body, and violations of our client’s due process rights.  The Complaint filed on behalf of our client was so effective that the municipality agreed to repeal the amendment, in its entirety, less than three weeks after it was received.

    Partner William F. Harrison and Associate Lisa A. John Win Superior Court Challenge of Planning Board Denial

    On December 15, 2008, the Ocean County Superior Court issued a written opinion reversing a local Planning Board’s denial of a 497 lot subdivision application based on the legal argument set forth by Mr. Harrison and Ms. John challenging the denial.  On behalf of our client, our attorneys successfully overcame the standard of review that a local planning board’s action is presumptively correct.  Following a trial on the matter, the Court found that the Plaintiff sustained its burden of proof before the Board and the denial of Plaintiff’s application was arbitrary, capricious and an unreasonable exercise of the Planning Board’s discretion.  As a result, the Court reversed the denial and directed the Board to adopt a Resolution granting the subdivision application.

    Mr. Harrison and Ms. John are member of the Commercial Real Estate, Redevelopment & Environmental Law Practice Group and are based in the Newark, New Jersey office.

    Brian W. Kronick and Hollie B. Knox to Speak at New Jersey State League of Municipalities Seminar

    Partner Brian W. Kronick and associate Hollie B. Knox, members of the GBV Labor Law Practice Group, will be speaking at the New Jersey State League of Municipalities Professional Development Seminar, “Labor and Employment Law – Year End Review” to be held on Friday, December 12th from 8:30am to 1pm at the Mercer County Community College Conference Center.  The GBV legal team will review developments during 2008 affecting public sector employers and employees in the legislative, judicial, and administrative areas and will cover such topics as new provisions to the Paid Family Leave Act and changes to the Pension System. 

     

    Mr. Kronick currently serves as League Labor Counsel.

    The Newark office will be host to an Executive Employment Law Roundtable for the Day Spa and Health Club Industries on Thursday, December 11th from 11:30am to 1:00pm.  GBV associate Dena B.     Brian W. Kronick Speaks at New Jersey State League of Municipalities Annual Conference

    Partner Brian W. Kronick was a speaker at the New Jersey State League of Municipalities 93rd Annual Conference on Wednesday, November 19th.  His speech on “Negotiating Changes in Health Benefits” covered such topics as the recent changes to the State Health Benefit Plan (SHBP), Public Employment Relations Commission (PERC) decisions regarding health benefits, and approaches to negotiating changes in health benefits.  The convention is being held at the Atlantic City Convention Center and concludes Friday, November 21st.  Mr. Kronick is a member of the firm’s Labor Law Practice Group and is based in the Newark, New Jersey office.

    Peter R. Yarem Wins Summary Judgment in $25 Million Commercial Foreclosure Case

    Partner Peter R. Yarem, assisted by associate Kenneth B. Goodman, filed a Complaint in Foreclosure on behalf of a commercial Lender seeking to foreclose on a commercial real estate mortgage securing a $25 million loan.  An Answer was filed on behalf of the Borrower asserting that the Lender had acted in bad faith and in breach of contract for failure to disburse reserve funds, which caused the Borrower’s default.  The Borrower further asserted that the Lender had conspired to cause the Borrower’s default, and had tortiously interfered with the prospective economic advantage of the Borrower.  Thereupon, the Office of Foreclosure deemed the case contested.

     

    A Motion for Summary Judgment was filed on behalf of the Lender by Mr. Yarem.  In a written Decision filed on October 28, 2008, Judge Robert P. Contillo, J.S.C., found that the Lender had conclusively established multiple instances of default and had property exercised its rights under the loan documents. Concluding that the Borrower’s allegations of bad faith and conspiracy were “mere speculations, unsupported by any evidence”, the Court granted Summary Judgment striking the Borrower’s Answer and Affirmative Defenses and permitting the case to proceed as an uncontested foreclosure.

    Sandro Polledri Wins Summary Judgment in Whistleblower and N.J. Civil Rights Act Case

    Partner Sandro Polledri represented a large public school district in a case brought by a tenured teacher.  The plaintiff alleged that the school district retaliated against him in violation of the Conscientious Employee Protection Act ("CEPA") for making complaints about the district's compliance with the No Child Left Behind statute and the qualifications of teachers.  The plaintiff also asserted that the district violated the New Jersey Civil Rights Act because he was not granted a hearing while he was under investigation for allegations of misconduct brought by students.  The court dismissed the CEPA claim because the plaintiff continued to receive his wages and benefits and did not suffer an adverse employment action.  The court likewise dismissed the N.J. Civil Rights Act claim because the teacher was not deprived of any salary or property, and the law did not require the school district to give him a teaching assignment while the students' complaints were being investigated.

She was inducted into the Order of the Barrister and also served as President of the South Asian Law Students Association from 2001-2002.

    Corporatepoliticalactivitylaw.com article noted in Crain's Insider and The Daily Politics

    Today’s issue of Crain’s Insider noted partner Laurence D. Laufer’s article from the www.corporatepoliticalactivitylaw.com blog on novel legal complications in changing New York City’s term limits law without a referendum.  As stated in Crain’s, “Laufer says [the state’s Municipal Home Rule Law] could lead the courts to reject an extension for the council but uphold one for the mayor, comptroller, public advocate and borough presidents.”

     

    Laufer’s article is garnering attention, including by The Daily News’s political blog, the Daily Politics, which notes that the article has “sent a chill down the spine of City Hall insiders.”

    Genova, Burns & Vernoia is pleased to announce the promotions of Jennifer Borek, Jennifer Mazawey and John R. Vreeland to Counsel. 

     

    Ms. Borek, a 1997 graduate of Seton Hall University Law School, joined the firm in February 2004 and is a member of the Complex Commercial Litigation Practice Group.

     

    Ms. Mazawey, a 1997 graduate of Seton Hall University Law School, joined the firm in September 2002 and is a member of the Commercial Real Estate, Redevelopment & Environmental Law Practice Group.

    Genova Receives a "Total Win" in Strahan Divorce Case

    After a lengthy court battle, beginning in early 2005, Angelo J. Genova wins appeal of retired Giants defensive end Michael Strahan’s $18,000 – a – month child support obligation imposed in his 2006 divorce.  New Jersey Appellate Court ruled the decision to be exorbitant and unfairly apportioned against Strahan.

    Angelo J. Genova to Serve on Catholic Charities Board

    Angelo J. Genova, partner and co-founder, has been selected to serve on the board of the Catholic Charities of the Archdiocese of Newark.

    The Catholic Charities board of directors consists of local leaders from Newark and the surrounding areas. “Our board members, number one, believe in our mission and are willing to carry this mission through,” stated Dr. Phil Frese, President and CEO of the Catholic Charities of the Archdiocese of Newark.   The organization in Newark, founded in 1903, assists more than 80,000 individuals and families each year through more than 50 programs, and nationally more than 7.8 million people of all faiths, each year.  “Angelo is one of the regions most outstanding attorneys and heads up one of the largest firms in the area, poised to relocate its headquarters to Newark in the fall.  He is noted for his generosity and humanitarian work and it seemed like an excellent fit,” said Dr. Frese.

    GBV Associates Jennifer Mazawey and Dina M. Mastellone Win Challenge of Award of a General Construction Contract Under the New Jersey Public School Contracts Law

    GBV Associates Jennifer Mazawey and Dina M. Mastellone successfully obtained the dismissal of a claim brought by an unsuccessful bidder challenging a Board of Education's decision to award a general construction contract for a new elementary school. The unsuccessful bidder claimed the consent of surety submitted by the lowest bidder was defective. On June 24, 2008, the Superior Court, Essex County (Giles, F. Michael, J.S.C.) upheld the decision of the Board of Education, denied Plaintiff's request for a preliminary injunction and dismissed the Complaint in Lieu of Prerogative Writ in its entirety.

    GBV Partners Francis J. Vernoia and Kathleen B. Einhorn Prevail on Appeals Challenging Denial of Benefits in Mass Unemployment Case

    GBV Partners Francis J. Vernoia and Kathleen B. Einhorn successfully defended appeals brought by twenty-two individuals who had challenged decisions denying their entitlement to New Jersey unemployment compensation benefits.  The individuals brought twenty-two separate appeals challenging verdicts which Francis J. Vernoia and Kathleen B. Einhorn had obtained after a lengthy trial. On June 18, 2008, the Appellate Division of the Superior Court issued a series of decisions upholding the verdicts and denying the individuals’ claimed entitlement to benefits.

    GBV Partner Francis J. Vernoia Obtains Summary Judgment Dismissing Civil Rights Lawsuit

    GBV Litigation Group Director Francis J. Vernoia has obtained summary judgment dismissing a multi-count civil rights complaint against a New Jersey County Prosecutor's Office, the County Prosecutor and four of the County Prosecutor's Staff. The Complaint, which was dismissed in its entirety, alleged that GBV's clients had violated the plaintiff's rights under the U.S. Constitution and had otherwise engaged in the false arrest and malicious prosecution of the plaintiff. GBV Associate Kenneth B. Goodman assisted Mr. Vernoia in obtaining the dismissal of the Complaint.

    Angelo J. Genova to Speak on Harvard Law School Association Panel

    GBV partner, Angelo J. Genova, former Counsel to the New Jersey Democratic State Committee, will speak on a panel at the Harvard Law School Association of New Jersey’s (HLSA-NJ) annual Spring Symposium.  The panel will be held at the New Jersey Law Center in New Brunswick on Monday, June 16th.  Participating on the panel with Mr. Genova will be Mark D. Sheridan of Drinker Biddle & Reath, General Counsel to the New Jersey Republican State Committee and moderating the panel discussion will be Peter Woolley, Professor of Comparative Politics at Farleigh Dickinson University in Madison.  The discussion will cover topics such as: the strategic and tactical issues that campaigns confront, election related policy questions and expectations for the Fall of 2008.

    GBV Announces Relocation of Red Bank Office

    Genova, Burns & Vernoia’s Red Bank office has relocated to the Red Bank Corporate Plaza at 141 West Front Street. The move is in keeping with the firm’s growth and expansion initiatives. The new office space will more than double in size the current Red Bank location helping to accommodate GBV’s growing commercial real estate practice and access to the full-range of services that the firm offers.  In addition, the new location is closer in proximity to the Red Bank train station.

    The new Red Bank office will open Monday, June 2nd.

    Angelo J. Genova to Present at 30th Annual Litigating Employment Discrimination Claims Conference

    Partner Angelo J. Genova will be presenting at the 30th Annual Litigating Employment Discrimination Claims conference for the Practising Law Institute.  The Practising Law Institute (PLI) is one of the most prestigious providers of continuing legal education and selects only the most experienced practitioners as faculty.  Mr. Genova will be lecturing on the use of statistical evidence in establishing and defeating a prima facie case of disparate impact discrimination as well as recent developments and the expanding use of statistics to prove disparate treatment discrimination.  The conference will be held at the Practising Law Institute Conference Center in New York on Tuesday, June 17th

    Angelo J. Genova to be Inducted into Essex County Democratic Committee Hall of Fame

    GBV partner and co-founder, Angelo J. Genova, will be inducted into the Essex County Democratic Committee Hall of Fame at a dinner ceremony Monday, May 19th in Belleville, New Jersey.  This recognition comes after almost three decades of work and commitment as the legal representative of the New Jersey Democratic Party and numerous party candidates and officials.  Mr. Genova served two terms as Chair of the Election Law Committee for the New Jersey State Bar Association in 1998 and 1999.  Mr. Genova will share this honor with Senator Nia Gill and the Honorable John Clancy.

    GBV Attorneys Ready for Fresh Air Fund Charity Softball Tournament

    On Wednesday, June 18th attorneys from Genova, Burns & Vernoia and a total of 15 teams made up of north jersey law firms will take the field once again for the 22nd Annual “Battle of the Barristers” charity softball tournament.  Since 1987, Northern New Jersey law firms have teamed up once a year for a full-day, round-robin softball tournament event from which the entire proceeds are donated to the Greater Newark Fresh Air Fund.  Umpires include judges from New Jersey courts.  Last year the event raised over $131,600 making it possible for 526 low-income and special needs children to spend a week at camp. 

     

    The 2008 tournament will begin at 2pm at Brookdale Park in Bloomfield, New Jersey.  The two teams with the best record at the end of the round-robin will compete in the championship game which will be held that evening at the Bears & Eagles Riverfront Stadium in Newark.  GBV partner and co-founder Angelo J. Genova serves as chair of the 2008 Greater Newark Fresh Air Fund.

    GBV Client Awarded a $21 Million Anti-Smoking Advertising Contract -- Legal Battle Erupts Over State's Decision

    GBV client, Winning Strategies Public Relations, was recently awarded a three-year, $21 million anti-smoking advertising contract by the state.  Another bidder, Cedar Knolls advertising firm, Brushfire Inc., is disputing the contract claiming Winning Strategies has ties to a “sister” company which has represented a major tobacco company for two decades.  GBV co-founding partner, Angelo Genova, and partner, Kathleen Einhorn, strive to prove that the campaign was won completely through merit and that claims of a conflict are without foundation.  The issue is now before a state court of appeals.

    Norman J. Peer to be Keynote Speaker at Fundraiser for Child Center

    Of Counsel Norman J. Peer will be the keynote speaker at the Monmouth County Child Advocacy Center gala dinner.  The dinner, which will be held at the Battleground Country Club in Manalapan, NJ on Saturday, April 12, is hosted by the “Friends of Monmouth County Child Advocacy Center.”  The gala dinner will serve as a fundraiser to help the child center during its time under construction.  The center will be a place where troubled children can access medical care and mental health, social advocacy and law enforcement services following abuse.

     

    Mr. Peer was a Family Court Judge for nine years sitting in Freehold hearing hundreds of abuse and neglect and termination of parental rights cases.  He has been a foster parent to over 35 children. He is a member of the GBV Business Law & Commercial Transactions Practice Group.

    Genova, Burns & Vernoia Receives Successful Result in Long-Standing Bid Protest

    A long and complex bid protest lasting over a year, ended in a successful decision for GBV attorneys Frank Vernoia, Keith Krauss and Rebecca Moll Freed.  In October 2006, our client was awarded a contract by the New Jersey Economic Development Authority (NJEDA) and a protest was filed by the incumbent contract holder.  Determining that the RFP was unclear, the NJEDA reissued the RFP in July 2007 and again expressed its intent to award the contract to our client in September 2007.  After a second protest, our client ultimately prevailed in March 2008 and is expected to begin performing on the contract in the near future.

    On Remand from Supreme Court, Genova, Burns & Vernoia Receives Favorable Ruling in the Longest Running Election Contest of its Kind in New Jersey

    Genova, Burns & Vernoia co-founding partner, Angelo Genova, and associate, Peter Cammarano, received a favorable decision from the Morris County Superior Court for an election contest case that lasted over two years.  In November 2005, our client, Michael Luther, was elected Mayor of Parsippany by a 39-vote margin of victory.  The election results were challenged by the runner-up, Rosemarie Agostini, which started the legal odyssey that took the matter from the Morris County Superior Court, then to the Appellate Division, to a New Jersey Supreme Court published decision that clarified decades-old case law and then remanded for trial at the Morris County Superior Court which conducted a two-week trial.

    George Schneider Featured in Article Commemorating 40th Anniversary of the Public Defender's Office in Newark

    The Sunday, December 23, 2007 issue of The Star Ledger, featured a nostalgic article recognizing Schneider as one of the five founding members of the Public Defender's Office in Newark.  Celebrating the anniversary, four of the five founders gathered to reminisce about the roles they played in setting up the Public Defender's Office in Newark after a 1963 U.S. Supreme Court decision, Gideon vs. Wainwright, found that indigent defendants were entitled to a sound defense.  And the rest is history
